Welcome to Zenvi Boutique! These Terms (“Terms”) govern your use of our website and services (“Services”) and every purchase you make. The terms “we”, “us” and “our” refer to Zenvi Boutique, operating in Queensland, Australia. By using our Services or completing a purchase, you accept and agree to these Terms and our Privacy Policy. If you do not agree, please do not access or use our Services.

1. Australian Consumer Law & Guarantees

We operate under the Australian Consumer Law (ACL), embedded in the Competition and Consumer Act 2010, which provides for consumer guarantees on goods and services. These guarantees include:

  • Acceptable quality, fitness for purpose and matching description
  • Remedies for major failures (refund or replacement), and for minor failures (repair)
  • Guarantees cannot be contracted out of – any attempt to override them is void 

We comply fully with ACL obligations ([Business.gov.au](https://business.gov.au/legal/fair-trading/australian-consumer-law-and-your-business)) and will provide remedies accordingly.

2. Access, Account & Age

By using our Services, you confirm you are at least 18 years old or have parental/guardian consent. You are responsible for all activity under your account and must provide and maintain current and accurate information.

3. Products, Representations & Availability

We do our best to display our products accurately, but colour and appearance may vary depending on your screen settings and lighting conditions.

Some product photos used on our website and social media may be AI-generated or AI-enhanced for visual styling or conceptual representation. While these images are based on real products and accurate descriptions, slight visual differences may occur between these images and the physical product received.

We reserve the right to update or discontinue products, pricing, or availability at any time without notice.

4. Orders, Acceptance & Consumer Use

By placing an order, you offer to purchase goods under these Terms. We confirm acceptance only once payment is processed and your order is dispatched. Purchases are for personal or household use only, not for commercial resale.

5. Pricing, Billing & Promotions

All prices are in AUD, may exclude shipping, taxes, or import duties, and may change without notice. Promotional and discount offers are subject to their own terms. You confirm that your billing information is true, accurate, and valid.

6. Shipping, Delivery & Risk

Delivery times are estimates only. Risk and title pass to you on dispatch. We are not liable for delivery delays caused by carriers, customs, or events beyond our control.

7. Returns, Refunds & Faulty Items

Our Returns & Refunds Policy reflects ACL rights. We do not offer blanket refund exclusions—even sale or clearance items may be returned if faulty or not as described.

8. Privacy & Data Use

We handle your personal information strictly according to our Privacy Policy and the Privacy Act 1988, in compliance with Australian Privacy Principles.

9. Intellectual Property

All shop content—text, images, logos, trademarks—is owned by Zenvi Boutique or licensors. You may only view, download, or print for personal use. No other use is permitted without written consent.

10. Acceptable Use & Prohibited Conduct

You must not misuse our Services (e.g. posting offensive material, unauthorized data scraping, distributing malicious content). We retain the right to revoke your access or cancel orders if you breach these terms.

11. Third‑Party Content & Links

We may link to external sites or integrate third-party tools. We do not monitor or endorse their content, and we are not liable for their practices. Use such tools at your own risk.

12. Relationship with Shopify

Our store is powered by Shopify, but all purchases are made with Zenvi Boutique. Shopify is not responsible for any aspect of orders, products, services, or disputes.

13. Online Safety & Compliance

We comply with Australia’s Online Safety Act 2021 for managing harmful online content.

14. Spam, Marketing & Communication

We comply with the Spam Act 2003. Marketing messages are only sent with your consent, clearly identifying us and including an easy opt-out. Unsubscribe requests are processed within 5 working days.

15. Electronic Transactions

These Terms satisfy the requirements of the Electronic Transactions Act 1999. Digital conduct—clicks, e-signatures—are equally binding.

16. Disclaimer, Warranties & Liability

To the extent permitted by law, all Services and products are provided "as-is". We exclude all implied warranties, but consumer guarantees under ACL cannot be excluded. We limit liability for indirect, incidental, or consequential losses.

17. Dispute Resolution & Governing Law

These Terms are governed by the laws of Queensland, Australia. Any dispute will be resolved in Queensland courts. Consumers may also seek relief under ACL via ACCC or state fair‑trading bodies.

18. Changes to Terms

We may update these Terms at any time. Material changes will be notified on our website or via email. Continued use means acceptance of updated Terms.

19. Severability, Waiver & Assignment

If any part of these Terms is invalid under law, the remainder remains enforceable. Failure to enforce any term isn't a waiver. You may not transfer these Terms; we may assign to affiliated entities.
